2. Scope of these terms
These terms apply to:
The following policies also form part of these terms:
Where a written quotation, event listing or corporate agreement contains specific terms, those terms will apply to that booking or order. These general terms continue to apply except where the written agreement clearly says otherwise.
3. Age requirement
You must be at least 18 years old to:
By placing an order, you confirm that you and the intended recipient are aged 18 or over.
We may use age-verification controls and require suitable proof of age. We may refuse or cancel a sale, delivery or service where age cannot be verified or where supply would be unlawful.
4. Product information
We take reasonable care to describe products accurately.
However:
Where a particular vintage, certification, closure, packaging style or dietary characteristic is essential, please contact us before ordering.
5. Availability and substitutions
All products are subject to availability.
We will not substitute a materially different wine without the customer’s agreement.
Where an ordered product is unavailable, we may:
A minor label or packaging update does not normally amount to a product substitution.
6. Placing an order and contract formation
When you submit an order, you are making an offer to buy the products or services shown.
An automated order acknowledgement confirms that we have received the order. It does not necessarily mean that we have accepted it.
A binding contract is formed when we:
We may decline an order before acceptance because of stock availability, a pricing error, licensing requirements, suspected fraud, delivery restrictions or another reasonable business reason.
Where payment has already been taken for an order we cannot accept, we will issue a refund.
This order-and-acceptance structure is commonly used by wine retailers to deal fairly with stock changes and pricing errors before dispatch.
7. Prices
Prices are shown in pounds sterling.
The price displayed at checkout is the total product price payable, subject to any separately displayed delivery charge.
Beyond the Cork is not currently registered for VAT. We therefore do not issue VAT invoices.
We take reasonable care to display accurate prices. If an obvious pricing error is discovered before acceptance, we will contact the customer and provide the option to proceed at the correct price or cancel for a refund.
We will not increase an accepted order price without the customer’s agreement.
8. Payment
Payment must be made using an available checkout method or another method expressly agreed with us.
Payment may be processed by an independent payment provider. That provider’s terms and security procedures may also apply.
An order may be delayed or cancelled where payment is declined, reversed or suspected to be fraudulent.
9. Promotions and discount codes
Promotions apply only for the dates and products stated.
Unless expressly indicated:
The customer’s statutory rights are unaffected.
10. Delivery
Delivery is governed by our Shipping and Delivery Policy.
The customer is responsible for providing an accurate address and ensuring that a suitable person aged 18 or over is available to receive the order.
Estimated dates are not guaranteed unless expressly agreed as guaranteed.
11. Cancellation, returns and refunds
Cancellation, return and refund arrangements are set out in our Returns and Refunds Policy.
Nothing in these terms restricts statutory rights concerning goods that are faulty, damaged, not as described or otherwise fail to meet consumer-law requirements.
12. Private tastings
The booking confirmation will state:
Unless otherwise agreed:
13. Public and corporate events
Event descriptions will explain what is included in the ticket or booking.
We may make reasonable changes to wine selections, speakers, timings or event arrangements where necessary, provided the overall nature and value of the event are not materially reduced.
We may refuse admission or alcohol service to a person who:
No refund will normally be due where service or admission is refused because a person has failed to comply with clearly stated age, identification or conduct requirements.
14. Event cancellation
Customer and Beyond the Cork cancellation arrangements are set out in the Returns and Refunds Policy and any event-specific listing.
Where we cancel, we will offer a refund or suitable alternative.
We are not responsible for separate travel, accommodation or other arrangements made independently by a guest, except where liability cannot legally be excluded.
15. Wedding and party consultations
The consultation description or quotation will state:
Recommendations concerning quantities are estimates based on the information supplied by the customer. Final purchasing decisions remain with the customer.
Sale-or-return is available only where confirmed in writing and is subject to the Returns and Refunds Policy.
16. Gifts and corporate orders
The purchaser is responsible for ensuring that:
Larger corporate orders may be subject to a separate quotation, lead time, deposit and cancellation schedule.
Where a separate corporate agreement conflicts with these general terms, the written corporate agreement will take priority for that order.
17. Gift vouchers
Unless the voucher states otherwise:
If a voucher is lost, contact us with proof of purchase. Where we can verify that an unused voucher belongs to the customer, we may cancel and reissue it.
18. Website use
You must not:
We may restrict access where reasonably necessary to protect customers, the website or the business.
19. Intellectual property
Website content is protected as described in our Copyright and Intellectual Property Notice.
Purchasing a product, booking or ticket does not transfer ownership of our branding, tasting materials or other intellectual property.
20. Privacy
Personal information is handled in accordance with our Privacy Policy and Cookie Policy.
21. Our responsibility to consumers
We are responsible for losses that are a foreseeable result of our breach of contract or failure to use reasonable care and skill.
We are not responsible for a loss that was not reasonably foreseeable when the contract was formed.
Where you are acting as a consumer, we are not liable for business losses, loss of profit, loss of business or business interruption.
Nothing in these terms excludes or restricts liability for:
22. Circumstances outside our control
We are not responsible for delay or failure caused by circumstances outside our reasonable control, such as severe weather, transport disruption, industrial action, supplier failure, venue closure, power or internet failure, public emergency or legal restriction.
We will take reasonable steps to minimise the effect, inform affected customers and offer an appropriate solution where performance is materially delayed or becomes impossible.
23. Complaints
Please contact us first so that we have an opportunity to resolve the matter.
Email: simon@beyondthecork.co.uk
Telephone: 07711 876033
Please include your order or booking number and a clear explanation of the issue.
Data-protection complaints are handled separately under the Privacy Policy.
24. Changes to these terms
The terms applying to an order or booking are normally those in force when the contract is formed.
We may update these terms for future orders and bookings. The date at the top identifies the latest version.
25. Severability
If a court or relevant authority decides that part of these terms is invalid or unenforceable, the remaining provisions will continue to apply.
26. Governing law
These terms are governed by the law of England and Wales.
A consumer living elsewhere in the United Kingdom retains any mandatory rights applying where they live and may bring proceedings in the courts available to them under applicable consumer law.
